Gas Safety Certificates

What Happens If a Landlord Gas Safety Certificate Expires?

A landlord gas safety certificate should never simply be allowed to lapse. UK landlords are responsible for arranging an annual gas safety check on the gas appliances and flues they provide for tenants. If the previous record expires before the next check is completed, the landlord may no longer be meeting their legal gas safety duties.

The important thing is to act quickly. An expired certificate does not become valid again because an appointment has been booked. Arrange a new landlord gas safety check with a Gas Safe registered engineer as soon as possible and keep clear records of the action taken.

How Long Does a Landlord Gas Safety Certificate Last?

A landlord’s gas safety record is normally valid for 12 months. The check must be completed by a Gas Safe registered engineer who is competent to work on the relevant appliances.

Landlords do not have to wait until the final few days before renewal. HSE guidance allows an annual gas safety check to be completed during the two months before it is due while retaining the existing annual renewal date, provided the relevant requirements are followed.

This gives landlords a useful window for arranging annual gas safety checks without leaving everything until the last minute.

What Should You Do If Your Gas Safety Certificate Has Expired?

If your landlord gas safety certificate has expired, arrange the inspection as soon as possible.

A Gas Safe registered engineer can inspect the relevant landlord-provided gas appliances and flues and produce a new gas safety record. If the check identifies a defect, the record should still be issued, with necessary remedial work recorded separately.

Keep evidence showing when the previous record expired, when the new inspection was arranged and when it was completed. Gas safety records must generally be retained for at least two years.

If you use a letting agent or property manager, check who is responsible for arranging gas safety checks under your agreement.

Can Tenants Stay in a Property With an Expired Certificate?

Landlords have an ongoing duty to maintain the gas appliances, fittings and flues they provide and arrange the required annual check.

If a certificate expires while tenants are already living at the property, the priority should be arranging the overdue check without unnecessary delay. Existing tenants must receive a copy of the new gas safety record within 28 days of the check.

For a new tenancy, the current gas safety record should be supplied before the tenant moves in. Staying on top of landlord certificates is therefore particularly important when a property is being re-let.

What If the Tenant Will Not Allow Access?

Sometimes a gas safety certificate expires because an engineer has been unable to access the property.

Landlords must not force entry simply to complete a gas safety check. HSE guidance says landlords should instead be able to show that they took reasonable steps to comply.

This can include contacting the tenant, explaining why the gas safety inspection is required, offering opportunities to arrange an appointment and keeping records of correspondence and attempted visits.

What Happens If You Do Not Renew a Gas Safety Certificate?

Failing to comply with landlord gas safety duties is a legal matter, not simply an administrative oversight. The Health and Safety Executive says breaches can result in enforcement action and may lead to a substantial fine and/or a custodial sentence.

There is also a practical issue: an overdue check means there is no current annual inspection record confirming the results of the required checks on relevant landlord-provided appliances and flues.

Regular boiler servicing is also worth considering alongside the legal gas safety check. A boiler service and a landlord gas safety check are not automatically the same thing. Servicing focuses on appliance maintenance, while the statutory gas safety check covers the safety requirements for rented properties.

How Can Landlords Avoid Missing the Renewal Date?

Treat gas safety as planned property maintenance rather than something to arrange only when the certificate is about to expire.

Keep a clear record of the renewal date, book the next check in advance and use the permitted early-renewal window where appropriate. Landlords with several properties may find it useful to maintain a schedule covering landlord gas safety certificates, boiler servicing and other recurring compliance work.

It is also sensible to arrange boiler repairs promptly when a fault is identified instead of waiting until the next annual inspection.
